She calls it "living expenses," not rent.

Judge Judy asks when he gave her the $200.

Diane says "that day that he came."

Judge Judy asks if Diane told the police he wasn't a tenant when she wanted him out.

Diane says yes.

Judge Judy asks if the police asked about any payments.

Diane says yes, and she was "very afraid."

Judge Judy asks if Diane told the police about the $200 payment.

Diane admits, "No, I did not."

Missing Personal Property

Mr. Pestori claims Diane has his personal property.

Diane confirms she has his vacuum, toilet paper, and baby wipes.

Judge Judy asks about his mattress.

Diane says it was a blow-up mattress.

She says he plugged it in when he arrived.

She recalls him saying he gets new ones for free because he breaks them.

Judge Judy asks if Diane has the blow-up mattress.

Diane says no.

She says they unplugged it, deflated it, and rolled it up neatly.

She put his stuff out "very gingerly."

Mr. Pestori's sworn complaint also lists a complete set of tools.

Diane says her son and she carried out his tools.

She put them on a tarp.

She says he came to pick up his belongings.

He acknowledges picking up everything except the vacuum.

The Change Jar and Wicker Chair

Mr. Pestori also claims his son's change jar is missing.

Diane confirms she has it.

Her son is eight.

She says the change jar goes with her.

Judge Judy dismisses the claim for the change jar.

Mr. Pestori also claims a wicker chair.

Diane says he never came for it.

She says he broke it when he was in a rage.

Her son saw him trashing things.

Rich's Loyalty

Judge Judy asks Rich if he is still talking to his aunt.

Rich says yes.

She tells Rich to pick up the vacuum and give it to Mr. Pestori.

Diane has a counterclaim for harassment.

She says Mr. Pestori was banging on her door and stalking her.

Judge Judy tells Rich to tell Mr. Pestori to stop if he is doing it.

Rich says his aunt did Mr. Pestori a favor.

He says his aunt was having financial difficulties and needed yard work.

He thought Mr. Pestori could help her.

Judge Judy asks Rich if he found Mr. Pestori's behavior odd.

Rich says no.

He trusts Mr. Pestori with his family.

The Real Reason for Eviction

Judge Judy asks Rich if he asked his aunt why she put Mr. Pestori's stuff out.

Rich says he did.

He says his aunt told him Mr. Pestori was not doing chores.

Rich says he told his aunt that "every woman likes to relax on a Sunday."

Diane then explains the real reasons.

She says Mr. Pestori was taking long showers.

He was smoking in her house.

He was playing loud music all night.

She asked him to leave.

She says she texted him.

He called her back.

He said he would be a squatter and not leave.

Diane says she became fearful.

She put his stuff out and put a lock on the door.

The Unfair Outcome

Judge Judy orders Rich to pick up the vacuum from his aunt.

Diane expresses that she thinks the outcome is unfair.

She says she was trying to help him.

She feels he took advantage of her.
