Case File

Door Kicked In at Birthday Bash

FULL VIDEO AT THE END OF THE POST

The Birthday Party Turns Violent

Missy LeBuff, the plaintiff, sued Chris, the defendant, for property damage.

She claimed Chris broke her front door.

The incident occurred during a dual birthday party Missy hosted.

Chris attended the party with his brother Matt, his younger brother, and his younger brother's friend.

Missy described the party as a "Fiesta party" with a rented tent, a band, an open bar, and food.

An Altercation and an Unconscious Brother

During the night, an altercation broke out.

One of Chris's younger brother's friends got into a fight with another party guest.

Matt, Chris's brother, intervened to break up the fight.

Matt was then assaulted and knocked unconscious.

Chris saw his brother Matt on the ground, unconscious.

He immediately turned to Missy and asked her to call 911.

Missy's Refusal to Call 911

Missy looked at Matt and stated she did not see him in a "911 emergency" state.

She claimed Matt was "getting up" and "standing up."

Judge Judy questioned Missy about Matt being on the ground if he was getting up.

Missy conceded that Matt was getting up off the ground.

Despite Chris's plea, Missy refused to call 911.

She suggested Chris take Matt to a hospital about a mile down the street instead.

Chris's Desperate Act

Chris, feeling ignored by Missy, took matters into his own hands.

He went to Missy's front door and kicked it down.

He then entered the house and called 911 himself.

After making the call, Chris came back outside.

He gathered his brother's friends, who were underage and had been drinking at the party.

Chris then left the party with them before 911 arrived.

The Aftermath and Police Involvement

When 911 arrived, Missy had to explain that there was no victim on the scene.

She stated that 911 threatened to charge her but ultimately let it go.

The next day, Chris and Matt returned to Missy's house.

They were there to pick up a friend who had stayed overnight.

Matt complained of injuries but had not yet gone to the hospital.

He went to the hospital the following morning.

Matt later filed a police report at the sheriff's station.

A class I felony assault with a deadly weapon warrant was issued for the assailant's arrest.

Blackmail Allegations

Missy also claimed that Chris tried to blackmail her.

She alleged Chris wanted her to find the assailant's name.

In exchange, Chris would fix her door.

Judge Judy questioned Missy about her lack of cooperation.

The judge pointed out that an invited guest was assaulted in Missy's home.

Judge Judy found it unusual that Missy would require "blackmail" to cooperate.

Matt's Testimony of the Assault

Matt, Chris's brother and the assault victim, then testified.

He stated he had little recollection after being assaulted.

Matt confirmed an altercation had occurred earlier in the night.

He tried to intervene, telling the aggressor, "we don't want to fight."

Matt then described being hit in the head.

He fell to the ground, shaking.

As he tried to get up, he was "booted" in the face.

Matt stated, "out I went," indicating he lost consciousness.

He confirmed a class I felony assault warrant was issued for the assailant.

Judge Judy's Scrutiny of Missy

Judge Judy strongly rebuked Missy for her downplaying of the incident.

The judge emphasized the severity of the assault.

She stated that Matt "couldn't have been killed."

Judge Judy challenged Missy's description of the event as "making a mountain out of a mole-hull."

She asked Missy how she would feel if she had been punched and kicked in the head at her own party.

Chris's Justification for His Actions

Chris explained his actions regarding the door.

He stated he felt badly about the door initially.

However, upon reflection, he questioned why he should fix it.

Chris asserted he would have done the same for anyone in that situation.

He believed he had no choice but to kick the door to call 911.

Chris stated he would "do it 100 times" again.

He would "kick 10 doors in" if necessary.

Chris felt ethically and morally obligated to act.

Witness Corroboration

Ed Marchant, another witness, provided corroborating testimony.

He confirmed Matt was "laying on the ground" and "attempting to get up" after the assault.

Ed Marchant was with Chris when he asked Missy to call 911.

He confirmed that Missy "did not go" to call for help.

Ed Marchant was also present when Chris kicked the door.

He almost got struck by Chris's foot as he kicked the door.

He witnessed Chris kick the door down in one attempt.

Ed Marchant did not see the initial strike but was less than 10-15 feet away.

He saw Matt on the ground and Chris upset.

He heard Chris ask Missy, the host, to call the police.

Ed Marchant confirmed that Missy did not make the call.

The Verdict

Judge Judy then delivered her ruling.

She stated, "This case is dismissed."

The judge found Chris's actions justified given the circumstances.
