The Warning Shot Incident

Furnished Williams, the plaintiff, brought a case against his ex-girlfriend, Candy Haramillo, the defendant.

He sought the return of his furniture and appliances.

The story began on September 16, 2018.

Mr. Williams was at home when he heard a noise.

Believing it was a burglar, he took out a shotgun.

He fired a warning shot.

Unfortunately, the shot went upwards through his ceiling.

It then entered his neighbor's apartment above.

This incident led to his arrest.

Arrest and Incarceration

Mr. Williams was taken to jail following the shooting.

His apartment lease was set to expire on September 30, 2018.

He faced the prospect of losing his apartment and all his belongings.

While in jail, he contacted his girlfriend, Ms. Haramillo.

He asked her to retrieve his property from the apartment.

He wanted her to hold onto his belongings until his release.

Mr. Williams spent 75 days in jail.

His case was eventually reduced to a lesser charge.

He was charged with a misdemeanor.

He was not on probation.

This was not his first offense.

Release from Jail

Mr. Williams was released from jail on November 29, 2018.

He received credit for time served.

Shortly after his release, his relationship with Ms. Haramillo ended.

They broke up around December 1, 2018.

This was approximately two days after he got out of jail.

The Missing Furniture Claim

Mr. Williams claimed that Ms. Haramillo took several items from his apartment.

He stated she took his living room set.

He also claimed she took his dinette set.

Additionally, he asserted she took his washer and dryer.

He expected her to hold these items for him.

He alleged she never returned them.

He had purchased a house full of furniture on December 17, 2017.

This was after he received a settlement.

He described the items he wanted back.

Defendant's Account of Retrieval

Ms. Haramillo confirmed she went to Mr. Williams's apartment.

She stated she retrieved some items around October 2018.

She admitted to taking the living room set.

She also admitted to taking the dinette set.

However, she denied taking the washer and dryer.

She claimed she only took those two sets of furniture.

Where the Furniture Went

Ms. Haramillo explained what she did with the furniture.

She stated she put the living room set and dinette set in her father's apartment.

Her father already had a living room set.

She said she removed her father's old furniture.

She then placed Mr. Williams's furniture in her father's apartment.

She claimed her father was aware of this arrangement.

Disputed Items and Instructions

Mr. Williams testified that he asked Ms. Haramillo to retrieve "everything."

He said she told him she got the living room set, dinette set, and washer/dryer.

He recalled her saying she did not have room for clothes or bedroom suits.

Ms. Haramillo maintained she did not take the washer and dryer.

She insisted she only took the living room set and dinette set.

She stated she just took "that."

The Living Room and Dinette Sets

Mr. Williams described the living room set.

It consisted of a couch, a love seat, and tables.

The dinette set included a table and chairs.

Ms. Haramillo confirmed these items were what she took.

She reiterated that she stored them at her father's apartment.

Judge Judy's Inquiry into Instructions

Judge Judy asked Mr. Williams about his instructions to Ms. Haramillo.

She wanted to know what he told her about removing his property.

Mr. Williams stated he asked her to go get his furniture.

He said he asked her to hold it for him.

He expected her to keep it until he could retrieve it.

Ms. Haramillo's Disability Settlement

Judge Judy questioned Ms. Haramillo about her financial situation.

Ms. Haramillo received a disability settlement in December 2018.

She stated she received $9,100 and something dollars.

She had initially applied for disability, but it was denied.

She then hired a lawyer.

The lawyer helped her secure her disability and back disability payments.

She confirmed the lawyer received a portion of the settlement.

She stated she received $2,500 from the settlement.

Timing of the Breakup and Settlement

Judge Judy noted the timing of events.

Mr. Williams was released from jail on November 29, 2018.

Ms. Haramillo broke up with him around December 1, 2018.

This was just two days after his release.

Her disability settlement arrived in December.

Judge Judy highlighted the proximity of these events.

Judge Judy's Assessment of Credibility

Judge Judy addressed Ms. Haramillo's claim about using the furniture.

Ms. Haramillo implied Mr. Williams told her she could use the furniture.

She suggested she could use it until she received her disability settlement.

Judge Judy stated, "I believe your story," to Mr. Williams.

This indicated Judge Judy's acceptance of Mr. Williams's account.

She did not believe Ms. Haramillo's version of events.

Judge Judy concluded that Ms. Haramillo was supposed to hold the furniture.

She did not believe Ms. Haramillo was given permission to use it.

The Verdict

Judge Judy ruled in favor of Furnished Williams.

She ordered Candy Haramillo to return the disputed items.

The order included the living room furniture.

It also included the dinette set.

Crucially, it included the washer and dryer.

Enforcement of the Order

A marshal will accompany Mr. Williams to Ms. Haramillo's residence.

The marshal will ensure the retrieval of the items.

Judge Judy issued a warning regarding the condition of the furniture.

If any of the items are damaged, Ms. Haramillo's appearance fee will be withheld.

She instructed Ms. Haramillo to ensure the furniture was in good condition.

She advised Ms. Haramillo to clean and polish the items.

Ms. Haramillo acknowledged the order.

The case was concluded.
