Case File

Who Is Responsible For Tween's Broken iPhone? (Page 2 of 2)

She asks if either of them got suspended.

She asks if the police spoke to him before or after his parents.

He says before.

After the police spoke to him, he went home.

He spoke to his mother the day after.

His mom comes home late.

He didn't get a chance to talk to her that day.

He lives with his mom.

His grandma watches him after school.

He did not tell his grandmother what happened.

He waited until the next day to speak to his mother.

The Police Coercion Claim

Stockton told his mother what happened.

He told her the police interviewed him.

They questioned him.

They told him if he didn't say he broke the phone, he would go to jail.

Judge Judy states she doesn't believe that.

She finds it hard to believe.

She asks his age.

He is 12.

She questions a policeman saying that.

Stockton clarifies the officer said he would put criminal charges on his record.

Judge Judy points out that is different from going to jail.

She asks if he told his mom both.

He says both.

He spoke to his dad maybe Sunday.

He gets a chance to talk to him at church.

He told his dad what happened.

He told him the police were leaving him.

Judge Judy separates the police involvement from the phone incident.

She states the police weren't there when the phone broke.

She wants to concentrate on what happened with the phone.

She asks Stockton when he first saw Isaiah.

He saw him after sixth period.

Isaiah approached him and tried to grab the phone.

He saw Isaiah again after winter break.

He has not spoken to Isaiah about the phone.

He didn't say anything to him about being blamed.

Judge Judy finds this strange.

Stockton says Isaiah is a mean kid.

He doesn't want problems with him.

He just kills his mom.

He says Isaiah gives other kids problems sometimes.

Isaiah has been in fights.

He is a bully.

Judge Judy Focuses on Responsibility

Judge Judy asks for the school report.

She then addresses Mr. Wilson.

She asks if he called Isaiah's parents.

He says he hasn't been able to.

He attempted to contact them.

They wouldn't give him Isaiah's full name.

He didn't know who the person was.

Judge Judy notes this is a week later.

She asks if the school or police contacted him.

The police contacted him.

The school never did.

Judge Judy tells Ms. Lynch she is separating the incidents.

One is the taking and destruction of the phone.

The other is whether the principal or police acted correctly.

Ms. Lynch understands.

Judge Judy states she is not there to evaluate the police or principal.

She is there to determine if their son was responsible.

Ms. Lynch confirms she understands.

Judge Judy wants her to concentrate on that.

She wants her to focus on her son's responsibility.

She asks if she gets that.

Ms. Lynch says yes.

The $400 Agreement

Judge Judy states it appears Ms. Lynch told Mr. Huckabee she would give him $400.

This was according to the police report.

This was over a week later.

She asks if Ms. Lynch told authorities she would pay $400.

She asks if the police report is inaccurate.

Ms. Lynch says she did agree to give money.

The police showed up at her house.

Judge Judy points out they are making it about the police again.

Ms. Lynch clarifies she is not making it about the police.

She says the first time she heard about it officially was from the police.

Judge Judy reminds her that her son told her the next day.

That was when she first heard about it.

Ms. Lynch says they didn't have the complete story.

Judge Judy states she had the complete version from her 12-year-old child.

Judge Judy's Scolding

Judge Judy explains that if a child commits a bad act, parents should act.

She is not saying this was a very bad act.

She is talking about a general bad act.

If parents find out immediately, they should address it.

The police not conducting an investigation appropriately does not diminish the wrongful act.

She tells Mr. Wilson the same.

The fact that he was officially told a week later is not an excuse.

She says he should pick up the phone.

Mr. Wilson disagrees.

Mr. Wilson denies this.

He says his son had no malicious intent.

It wasn't his fault.

Judge Judy says he just "crept into his mind."

She says Ms. Lynch told the police she would pay $400.

That is exactly what she is going to do.
