A Dog Attack on Private Property

Imagine a quiet evening turning into a chaotic dog attack.

That's what Ms. Stokes describes in Judge Judy's courtroom.

The Plaintiff Seeks Justice for Dog Attack

Ms. Stokes is the plaintiff.

She claims the defendant's dog bit her and her own dog.

The defendant is present.

She does not deny the biting.

However, she claims it was Ms. Stokes's dog's fault.

Ms. Stokes's husband is also present.

He was there during the incident.

The defendant was accompanied by two young men.

The Day of the Incident

The incident happened on April 6, 2017.

It was around 5 p.m.

Ms. Stokes has a small Yorkie.

She was on her property.

Her husband had just pulled in from work.

She came off her porch to talk to him.

The Defendant's Large Dog

The defendant was walking her dog up the street.

Her dog is a large German Shepherd mix.

She has had the dog for six or seven years.

Judge Judy asks about the dog's vaccinations.

The defendant admits the dog was un-inoculated.

Judge Judy calls this irresponsible.

The defendant agrees.

The Defendant's Version of Events

The defendant claims Ms. Stokes's Yorkie started yapping.

She says her dog was on a leash.

But it somehow got out of its leash.

Judge Judy questions this.

She suggests the dog was pulling hard.

The defendant says her dog was out of control.

It was on the sidewalk.

It was not far from Ms. Stokes's house.

The dog took a second to get onto Ms. Stokes's property.

Judge Judy asks if the dog went to play with the Yorkie.

The defendant says no.

She states her dog went to attack the yapping dog.

Ms. Stokes's Account of the Attack

Ms. Stokes says her dog did walk towards them.

But it was not yapping.

Her dog saw them coming across the yard.

She walked over to her dog.

She picked him up.

She was still on her property.

The defendant and her dog were by her mailbox.

They had already crossed her yard.

Ms. Stokes says the defendant's dog was not on a leash.

She picked up her dog.

She spoke to the defendant.

She said "hi and thank you."

She then turned around.

She started walking back towards her house.

Suddenly, something hit her from the right side.

It was the defendant's dog.

It was jumping up.

It was trying to snap at her face.

She was still holding her dog.

The dog hit her again.

She fell backwards onto the concrete.

She hit her head.

Her dog popped out of her arms.

The defendant's dog kept trying to get on her.

She was kicking and hollering.

The defendant and the two young men were just standing there.

The dog bit her leg.

Her husband ran to help.

He saved her when she hit the ground.

After she hit the ground, her dog popped out.

The dog bit her.

She saw her husband running.

She got up.

She let him know she was okay.

She then realized the dog came around.

It got her dog by the neck.

The Defendant's Inaction

Judge Judy asks what the defendant and her companions were doing.

Ms. Stokes says they were standing there.

She believes they were frightened of their own dog.

The Dog's Fate

She asks if the dog was quarantined.

Ms. Stokes says the dog was quarantined.

She also says they put the dog down.

Judge Judy notes there must have been a reason.

Ms. Stokes states they said the dog was dangerous.

Prior Incidents

Judge Judy asks if the dog had done this before.

The defendant says no.

She claims the dog had never bitten before.

Ms. Stokes contradicts this.

She says the defendant told her neighbors complained about the dog.

She says the dog had to be chained behind a fence.

The defendant confirms neighbors complained about barking.

She also admits the dog would jump the fence.

Judge Judy points out that jumping the fence means the dog was out of control.
