A Car Deal Leads to Courtroom Drama

Imagine buying a car from a friend's mother.

Then imagine that deal going completely sideways.

That is exactly what happened in Judge Judy's courtroom.

The Plaintiff Seeks Justice

Rachina Fennessy is the plaintiff.

She is suing Mary Williams, the defendant.

Ms. Fennessy wants her money back.

She also seeks punitive damages.

She claims harassment and deception.

The Car Agreement

Ms. Fennessy agreed to buy a car.

The car belonged to Ms. Williams' godfather.

Ms. Williams had power of attorney.

This agreement happened at the end of November last year.

Ms. Fennessy took possession of the car on November 22nd.

The agreement was for monthly payments.

The car payment was $283 per month.

This was owed to a finance company.

Insurance was also part of the deal.

Initial Payments and Confusion

Ms. Fennessy made an initial payment of $350.

This went to Larry Williams, the defendant's husband.

It covered the car note and a portion of the November insurance.

Ms. Fennessy paid in advance for November.

On December 1st, Ms. Fennessy paid $600.

She paid this because Ms. Williams claimed she owed for November insurance.

Ms. Williams said the insurance needed reactivation.

Ms. Fennessy provided proof of these payments.

Judge Judy noted further payments.

On December 30th, Ms. Fennessy paid $592 for January.

On February 2nd, she paid $556 for February.

Her total payments for the car and insurance amounted to $2,148.

The Missing Insurance Card

Ms. Fennessy had been asking for a new insurance card.

She had been asking for three months.

On March 1st, she did not make the March payment.

She had still not received the insurance card.

Ms. Williams then came to Ms. Fennessy's house.

She brought the police to retrieve the car.

Ms. Fennessy claims the car was disabled.

It was disabled when she went to drive it that night.

She says it was not disabled when she last drove it.

The car is now parked at a friend's home.

It is in West Philadelphia.

Ms. Fennessy says the car was towed there.

It has been stationary since March 7th.

Ms. Fennessy offered to return the keys.

She said she would do so if her money was returned.

Judge Judy Dismisses the Counterclaim

Ms. Williams had a counterclaim.

She stated she did not want the car.

She only wanted money.

Judge Judy dismissed this counterclaim.

"That's dismissed," Judge Judy stated.

"You're going to get your car back."

The Car's Value and Usage

Judge Judy addressed Ms. Fennessy.

She said it was not fair to get all her money back.

Ms. Fennessy had used the car for three months.

Ms. Fennessy claimed deception.

She said Ms. Williams told her there were six months left on the car.

There were actually 36 payments left.

The car is a 2011 Ford Focus.

Judge Judy asked Ms. Williams for proof of insurance.

Geico records showed coverage.

The car was covered from January 1st, 2017, to March 7th, 2017.

Ms. Williams claimed it was now covered again.

The Insurance Card Discrepancy

Judge Judy asked if Ms. Fennessy asked for an insurance card.

Ms. Williams said she gave Ms. Fennessy the card on February 28th.

Ms. Fennessy stated she received it on March 6th.

She said police intervention was involved.

Judge Judy focused on the insurance card issue.

She noted Ms. Williams' failure to provide it.

This was a key reason for Ms. Fennessy withholding payment.

Judge Judy's Calculation

Judge Judy considered the car's use.

She estimated a lease cost of $200 a month.

Three months of use would be $600.

Insurance coverage was $150 a month.

This added another $150.

Judge Judy deducted $750 from the total payments.

The total payments were $2,148.

This left a grand total of $1,398.

The Verdict

Judgment was for the plaintiff.

The amount was $1,398.

Ms. Williams would get her car back.

Judge Judy stated Ms. Williams did not have the right to retrieve the car.

This was because Ms. Fennessy had paid a lot of money.

Ms. Williams' counterclaim for money was dismissed.
