Case File

Neighbor Sued over Smelly Marijuana Plants and More! (Page 2 of 2)

Mr. Clark asked why.

Judge Judy explained that Mr. Stewart had put him on notice about the eight inches.

She said Mr. Clark was not to cut trees in that eight-inch area.

Mr. Clark stated, "I don't believe him."

Judge Judy dismissed his belief.

She advised that a neighbor should suggest a property survey and split the cost.

She said Mr. Clark should have done this in 2014.

The Property Survey and the Marker

Judge Judy asked Mr. Clark if he asked Mr. Stewart for his survey.

Mr. Clark said yes.

She asked if Mr. Stewart showed it to him.

Mr. Stewart then described Mr. Clark digging in the dirt with his fingers and a spoon.

Mr. Clark was trying to find a property marker, but never found it.

Mr. Stewart then presented his property survey.

He also had a photo of a property marker, a "pen," in the back of the property.

He said a similar marker was in the front, which he showed to Mr. Clark.

Mr. Stewart claimed Mr. Clark dug it up and threw it in his yard.

He added that concrete was poured around it.

Mr. Clark denied this.

Evidence of Cut Trees

Judge Judy asked to see pictures of the trees Mr. Clark cut down.

Mr. Stewart said he had photos of "other trees" Mr. Clark cut down.

Judge Judy clarified she wanted to see the picture of the tree Mr. Clark cut down.

Mr. Stewart mentioned Mr. Clark had a "stupid attitude."

Mr. Stewart's girlfriend, present as a witness, interjected.

She stated Mr. Clark cut one of the trees down "yesterday at 12 o'clock."

Mr. Stewart repeated his comment about Mr. Clark's attitude.

His girlfriend confirmed she was his girlfriend.

She then presented a picture from her home video camera.

The footage was from "yesterday" while they were at court.

It showed men cutting down the tree.

She explained it was on the back of her house.

The footage showed the time and sequence of the cutting.

Judge Judy asked to see it.

The girlfriend added it showed the tree down in Mr. Clark's yard.

Mr. Stewart stated this was the last of four trees Mr. Clark had cut down.

He said it was the last tree left on his side of the property.

The Trees and the View

Judge Judy asked whose house was visible in the photo.

Mr. Stewart identified it as Mr. Clark's house.

He explained that before, you couldn't see the house over the fence.

Now, with all the trees cut down, everything was visible.

Judge Judy confirmed Mr. Clark cut trees on the other side of the fence.

Mr. Clark agreed.

Mr. Stewart confirmed they were on his property.

Judge Judy asked to see the survey.

Mr. Stewart offered the photos with the pen mark.

The Fence and the Trees

Judge Judy observed that Mr. Stewart had trees planted in front of a fence.

Mr. Clark then explained his perspective on the fence.

He said the property survey showed an existing wire fence.

He claimed this fence did not follow the property line.

He stated all the trees were growing just inside that fence, on his side of that fence.

Mr. Clark said he wanted to save those trees.

He then "readjusted everything on the property and with the fence and the wall."

He claimed he made it a straight line with the property.

The Final Admission

Judge Judy asked Mr. Clark directly if he cut down these trees yesterday.

She asked if he caused them to be cut down yesterday.

Mr. Clark responded, "Yes, I did."
