THIS EXCUSE DID NOT GO WELL IN COURT!

A Renter's Claims Against His Former Landlord

Imagine being a month-to-month tenant.

Then imagine being asked to leave.

Now imagine suing your former landlord for moving expenses and renovation costs.

That is exactly what Johnny Gallegos did.

He brought his case before Judge Judy.

The Plaintiff's Story

Johnny Gallegos is the plaintiff.

He is suing Laurie Shaper, his former landlord.

Mr. Gallegos claims he is owed money for moving expenses.

He also wants reimbursement for renovations he made to the property.

He had been a tenant since 2011.

He initially signed a six-month lease.

This lease was with his father, who owned the property.

After the initial lease, he became a month-to-month tenant.

The Defendant Takes Over

Laurie Shaper is the defendant.

She is the daughter of the previous property manager.

She took over managing the property on July 1, 2015.

Ms. Shaper gave Mr. Gallegos a 30-day notice to vacate.

This notice was filed on January 23, 2016.

Mr. Gallegos was required to leave by February 29, 2016.

Judge Judy Questions the Moving Expenses

Judge Judy immediately addresses the moving expenses claim.

She asks Mr. Gallegos why he thinks Ms. Shaper is responsible.

Mr. Gallegos explains that he believes Ms. Shaper intentionally asked him to move.

He links this to rising rents in Colorado after marijuana became legal.

He says he had been doing upgrades to the property.

Judge Judy points out that Ms. Shaper was within her rights.

She states that Mr. Gallegos was a month-to-month tenant.

She explains that having no lease means the landlord can ask a tenant to move.

The Renovation Claim

Mr. Gallegos then claims he made renovations.

He believes Ms. Shaper should be responsible for these costs.

He had an arrangement with the prior property manager.

That manager was his father.

The Missing Bill

Judge Judy asks about the arrangement for renovations.

She asks if Mr. Gallegos presented a bill to Ms. Shaper.

Mr. Gallegos admits he never presented her with a bill.

Judge Judy quickly dismisses his case.

She states he has no agreement with Ms. Shaper for renovations.

The Counterclaim

Ms. Shaper then presents a counterclaim.

She states Mr. Gallegos made unauthorized changes to the property.

Specifically, he painted the cabinets white.

She wanted them returned to their original condition.

She wanted them as they were in 2011.

No Pictures from 2011

Judge Judy asks Ms. Shaper if she has pictures from 2011.

These pictures would show the original condition.

Ms. Shaper admits she does not have them.

She also cannot say exactly when the cabinets were painted.

She believes it was after she took over the property.

Judge Judy dismisses Ms. Shaper's counterclaim.

She declares the case is dismissed.
